1. General Terms and Conditions
These General Terms of Use and Purchase (hereinafter, "the General Terms") govern, together with the Privacy Policy and the Cookies Policy, access to and use of the website accessible via the domain name miolivagourmet.com under the Mi Oliva Gourmet brand (hereinafter, "the Website"), as well as buying olive oil, and the purchase of products and/or services through it. Simply accessing the Website gives the person doing so the status of Website User (hereinafter, "the User") and implies acceptance of all the terms included in these General Terms. If you do not agree with these General Terms, you must leave the Website immediately without using it.
By accepting these General Terms, the User declares:
- That they have read, understand and comprehend what is set out herein.
- That they are of legal age in accordance with the regulations in force in their place of residence; if not, the minor must have the authorisation of their legal representatives.
- That, if they intend to purchase any product and/or service, they have sufficient capacity to do so.
- That they accept all the obligations set out herein.
The User must read these General Terms carefully when accessing the Website, as the Website and these General Terms may be subject to changes, although any such changes will not affect goods or promotions that were purchased prior to the modification.
2. Purchase Terms
The Website is accessible to customers anywhere in the world, although online purchases are only available for mainland Spain, the Balearic Islands and the European countries listed as available in the "Country/Region" dropdown. Any other user whose country does not appear in the list may contact us at info@miolivagourmet.com to arrange their order through an alternative channel.
2.1. Purchase Process
Before buying, you can add as many products as you wish to your "cart" or "shopping basket." Once you have added products to the basket, you will proceed to the checkout. At that stage, your contact details will be requested; these details are stored in accordance with Organic Law 15/1999 of 13 December on the Protection of Personal Data, Royal Decree 1720/2007 of 21 December approving the Regulations implementing the Organic Law, and any other applicable data protection legislation in force at any given time (see the Legal Notice and Data Protection section).
You will then be able to complete payment through the available payment gateways. This data is not stored by us, but by the respective payment platforms. Payment is always processed via a secure protocol (SSL), so the data you enter is transmitted in encrypted form. Once payment is made, you will automatically receive an email with your order details; the order will be processed within 24 hours, between 8am and 8pm, excluding public holidays.
After payment, you will receive your invoice in electronic format and as a paper copy with your order. However, if you do not wish to receive a physical invoice with your order, simply indicate this in the order notes.
Estimated delivery times are between 48 and 76 hours within Spain and up to 7 working days for the rest of Europe, depending on the User's location and the day the order is processed. Public holidays and Saturdays are not included in this calculation. You can track your order through your personal account on the Website.
3. Pricing Policy
Product prices vary depending on the country in which the User is located. Please note that prices are displayed for each country using geolocation, so the User must ensure that their IP address reflects the correct location, as the final price will correspond to the delivery address. In the event of an error, the User has the right to claim a refund or to pay or receive the difference in price.
If the User places an order from one country but the delivery address is in another, the final price will always correspond to the delivery address.
3.1. Shipping Costs
Shipping costs are calculated based on the weight of the product and the delivery destination. The shipping cost will not be calculated until the customer has selected a delivery address (by default, this will be the primary address provided at registration or the last address used). In any case, the shipping cost will always be visible to the User before payment is made, and no additional charges will be requested after the order has been placed.
4. Payment Methods
The payment methods offered on the Website are owned by third parties (PayPal, Virtual POS, Bizum, etc.) and are processed through the payment gateway.
To pay by credit card via a virtual POS, the buyer must complete a form providing the cardholder's name, card type, card expiry date and security code. The Website does not have access to the bank details linked to the payment methods and does not access or store this data during the payment process.
5. Shipping Policy
We ship products purchased online to mainland Spain, the Balearic Islands and other locations within Europe, provided they appear in the list of available shipping destinations.
Shipping costs are the responsibility of the buyer, although free shipping may apply for certain products, geographical locations or order amounts. In any case, the applicable shipping costs will be detailed throughout the purchase process and the buyer will have the opportunity to review these costs before making any payment.
Mi Oliva Gourmet is not responsible for delays in the delivery of orders due to causes not directly attributable to us, including unforeseen events or force majeure. Orders will be delivered to the delivery address freely designated by the User. Mi Oliva Gourmet will not accept any liability where delivery of the product fails to take place as a result of inaccurate or false information provided by the User for that purpose, or in cases where delivery cannot be completed for reasons beyond Mi Oliva Gourmet's control, such as the recipient being absent at the delivery address.
If the recipient is absent and where possible, a delivery notice will be left with the information needed to arrange a new delivery attempt at the recipient's address, or instructions for the recipient to collect the product from a designated location. In any event, if the order has not been successfully delivered within 7 days of the last delivery attempt, it will be returned to the sender and the contract will be cancelled.
6. Returns Policy
The buyer will in all cases have 14 calendar days from receipt of the product to exercise their right of withdrawal, without needing to provide a reason or incur any penalty. To process a return, the product must be in perfect condition and in its original packaging. Once the goods have been received at our warehouse and their condition has been verified, the amount paid will be refunded using the same payment method used by the customer.
In accordance with Article 102(d) of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, or where applicable the supply of goods that may deteriorate or expire quickly, the right of withdrawal may not be exercised in respect of bottles that have been opened — for example, due to the rapid deterioration of the contents in such cases.
The buyer must notify their intention to withdraw within the stated period and must return the product as set out in our Returns Policy.
Mi Oliva Gourmet will refund all amounts paid by the User without withholding any costs. However, the cost of returning the product will be borne by the User.
Once the products subject to the withdrawal have been received and their condition verified, Mi Oliva Gourmet will refund the amounts paid to the User within a maximum of 10 calendar days. Products that are not returned in their original packaging may be subject to a reduction in value.
