1. General Terms and Conditions

These General Terms of Use and Purchase (hereinafter, "the General Terms") govern, together with the Privacy Policy and the Cookies Policy, access to and use of the website accessible via the domain name miolivagourmet.com under the Mi Oliva Gourmet brand (hereinafter, "the Website"), as well as buying olive oil and the purchase of products and/or services through it. Simply accessing the Website confers on the person doing so the status of Website User (hereinafter, "the User") and implies acceptance of all the terms included in these General Terms. If you do not agree with these General Terms, you must leave the Website immediately without using it.

By accepting these General Terms, the User declares:

  • That they have read, understand and fully comprehend the content set out herein.
  • That they are of legal age in accordance with the regulations in force in their place of residence; if they are a minor, they must have the authorisation of their legal representatives.
  • That, should they intend to purchase any product and/or service, they have the legal capacity to do so.
  • That they accept all the obligations set out herein.

The User must read these General Terms carefully each time they access the Website, as the Website and these General Terms may be subject to modifications; however, any such modification will not affect goods or promotions that were purchased prior to that modification.

2. Purchase Conditions

The Website is accessible to customers anywhere in the world, although online purchases are only available for mainland Spain, the Balearic Islands, and the European countries listed as available in the "Country/Region" dropdown. Any other user whose country does not appear in the list may contact us at info@miolivagourmet.com to arrange their order through an alternative channel.

2.1. Purchase Process

Before confirming an order, the customer will be able to review on screen the full details of their purchase, including selected products, quantities, total price with taxes, shipping costs where applicable, and billing and delivery details.

Placing the order creates a payment obligation on the part of the customer.

Once the purchase process is complete, the customer will receive a confirmation email with a summary of the order placed.

3. Data Protection

Personal data provided during the purchase process will be handled in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), as set out in the Privacy Policy of the website.

4. Pricing Policy

Prices for the various products vary depending on the country in which the User is located. Please note that prices are displayed per country through geolocation, so the User must ensure that their IP reflects the correct location, as the final price will correspond to the delivery address. In the event of an error, the User has the right to claim a refund or to pay or receive the difference in price.

If the User places an order from one country but the delivery address corresponds to another, the final price will always correspond to the delivery address.

4.1. Shipping Costs

Shipping costs are calculated based on the weight of the product and the delivery destination. The amount will not be calculated until the customer has selected a delivery address (which defaults to the primary address registered at sign-up or the last address used). In any case, the shipping cost will always be visible to the User before payment is made, and no additional charges will ever be requested after the order is placed.

5. Payment Methods

The payment methods offered by the Website to the user are owned by third parties (PayPal, Virtual POS, Bizum, etc.) and are processed through a payment gateway.

To pay by credit card via a virtual POS, the buyer must complete a form providing the cardholder's name, card type, card expiry date and security code. The Website does not have access to the banking details linked to the payment methods and does not see or store this data during the payment transaction.

6. Shipping Conditions

We ship products purchased online to mainland Spain, the Balearic Islands, and other locations within Europe, provided they appear on the list of countries as a shipping option.

Shipping costs are borne by the buyer and may be free for certain products, geographic locations or order amounts. In all cases, the applicable shipping costs will be detailed throughout the purchase process and the buyer will have the opportunity to review these costs before making any payment.

Mi Oliva Gourmet is not liable for delays in the delivery of orders caused by circumstances not directly attributable to us, including fortuitous events or force majeure. Orders will be delivered to the delivery address freely designated by the User. Mi Oliva Gourmet will not assume any liability if delivery of the product fails to take place as a result of inaccurate or false information provided by the User, nor in cases where delivery cannot be completed for reasons beyond Mi Oliva Gourmet's control, such as the absence of the recipient at the delivery address.

If the recipient is absent and circumstances allow, a notification card will be left with the information needed to arrange a new delivery to the recipient's address, or with instructions for the recipient to collect the product from a designated location. In any event, if 7 days have elapsed since the last delivery attempt without the order having been delivered, it will be returned to the sender and the contract will be considered terminated.

7. Returns Policy

The buyer has 14 calendar days from receipt of the product to exercise their right of withdrawal, under the terms set out in the Returns and Withdrawal Policy published on the website.

The buyer may also exercise their right of withdrawal entirely online, in accordance with Directive (EU) 2023/2673, via the dedicated form at miolivagourmet.com/pages/desistimiento, also accessible from the website footer.

8. Applicable Law and Dispute Resolution

These terms shall be governed by Spanish law.

In the event of a dispute, where the buyer has the status of consumer or user, the courts and tribunals of their place of domicile shall have jurisdiction.
