1. General Terms & Conditions
By accepting the present General Conditions, the User confirms:
- That they have read and understood the terms and conditions stated herein.
- That they are over the age of 18 and in agreement with the legislation in force in their place of residence, and if they are under the age of 18, that they have to have the authorisation of their legal representatives.
- That, in the case where they enter into a contract with regard to a product and/or service, they have sufficient capacity to do so.
- That they fulfil all of the obligations stated herein.
The User must carefully read the present General Conditions when they access the Website, given that the Website and these General Conditions may undergo modifications, although the modification of these General Conditions will not affect the goods or promotions that have been acquired previous to the modification.
2. Conditions of Purchase
The Website is accessible to customers throughout the world, although the online shop is only available for Spain. Any other user, located outside of Spain, can get into contact with us via firstname.lastname@example.org to arrange their order by a different method.
2.1 Purchasing Process
Firstly, before making a purchase, the User can add as many products as they like to their ‘basket’. Once the products are added to the basket, the User may proceed with the payment process. The User’s contact details will be required, information that is safeguarded according to Organic Law 15/1999 of December 13th on Personal Data Protection, Royal Decree 1720/2007 of December 21st which approves the implementing regulation of Organic Law and other legislation in force at all times and with relevance to data protection law (please refer to the Disclaimer and Data Protection section).
Following this, the User will be able to make the payment via the different payment platforms. This information is not stored by us, but by the platform indicated for this purpose. The payment will always be made securely via SSL protocol, through which submitted information is encrypted. After making the payment, the User will automatically receive an email with the order information, which will be dispatched within 24 working hours, which are between 8am to 20pm, and not including public holidays. The time of delivery varies between 48 and 96 hours from the time the order is dispatched, depending on the geographic location of the User and the day of dispatch. Festival days and Saturdays are not included in these estimations. It is possible to view the order process on your personal account with the Website.
3. Price Policy
The prices of different products vary depending on the country where the User resides. Remember that these prices are displayed in each country according to their geolocalisation, so the User should ensure that their IP address includes the correct location, given that the final price will correspond to the delivery address. Where errors occur, the User has the right claim back the cost or to credit or receive the difference in price.
If the User orders from one country, but the delivery address corresponds to a different country, the final price will always correspond to the latter address.
3.1 Delivery Costs
Delivery costs are calculated according to the weight of the product and destination of dispatch. The delivery cost will not be calculated until the customer selects a delivery address. (The address provided upon subscription or the last address used will be set by default.) In all cases, the Consumer will always be able to view the cost before initialising payment, and no additional costs will ever be charged after the order has been placed.
4. Payment Methods
The payment methods available to the User through the Website are the property of third parties (PayPal, POS, Virtual, etc.) through the payment gateway.
To use credit card via a virtual POS, the buyer must fill out a form with the cardholder’s name, card type, expiry date and security code. The Website does not have access to the bank details linked to these payment methods and does not receive or record these details during the payment process.
5. Conditions of Delivery
We only send products bought online to peninsular Spain.
Delivery costs will be charged to the buyer, and may be free for certain products, geographical locations and order quantities. Whatever the case, the delivery costs will be displayed throughout the purchasing process and the buyer will have the opportunity to revise these costs before effecting payment.
Mi Oliva Gourmet is not responsible for the delayed delivery of orders when the delay is not directly attributable to us, in instances of accident or in situations beyond our control. Orders will be delivered to the delivery address designated by the Consumer. Mi Oliva Gourmet will not assume responsibility for failures in product delivery which occur as a result of the inaccuracy or invalidity of information provided by the Consumer to this effect, nor in instances where the delivery cannot proceed for reasons unrelated to Mi Oliva Gourmet, such as the absence of the addressee from the delivery address.
In the case where the addressee is absent, and wherever possible, a note will be left with the information necessary for the Consumer to decide upon a new delivery arrangement or to come and collect the product from a specified location. In both cases, if 7 days have passed since the last attempt of delivery without subsequent success of delivery, the order will be returned to its source, and we will proceed to rescind the contract.
6. Returns Policy
In every case, the buyer has 14 calendar days from the receipt of the product to exercise their cancellation rights without having to provide justification or pay penalties. To return a product, it must be in perfect condition and in its original packaging. Once the goods are received at our warehouses, and an initial check of their condition has been completed, we will proceed with the reimbursement of its price, according to the payment method used by the customer.
In accordance with Article 102 (d) of Royal Legislative Decree 1/2007 of November 16th, which approves the revised text of the General Law on the Defence of Consumers and Users and other related laws, and is relevant to the supply of goods that may deteriorate or expire quickly, it will not be possible to exercise cancellation rights for bottles that have been opened, due to the rapid deterioration of the contents in such cases, for instance.
The buyer must express their intention of cancellation within the indicated time frame and must proceed with the return of the product. To this end, the Consumer may send an email to the email address email@example.com, providing their name and address, as well as their order number. They may also make contact via telephone in order to accelerate the reimbursement process.
Mi Oliva Gourmet will reimburse the amount paid by the Consumer free of charge. However, the return delivery of the product will be at the expense of the Consumer.
Once products for which the consumer has sought cancellation have been returned and their proper condition verified, Mi Oliva Gourmet will refund the Consumer with the paid sum within a maximum period of 10 calendar days. Products that do not return in their original packaging will be devalued.
